Informed consent for clients in consultation situations
The provision of psychology services, using technologies that allow communication between the professional and the client at a distance, for the purposes of counseling or therapy, is a practice with scientific validation.
This approach involves psychologists adhering to and following the Code of Ethics of the Order of Portuguese Psychologists, as well as all relevant laws, including those referring to the protection of individual rights with regard to the processing of personal data and the free circulation of such data. .
We strictly follow these requirements when providing information about the interaction that will be established during the therapeutic practice, as well as obtaining explicit and informed consent from clients for the underlying technical and commercial relationship.
1 - The data that mind4us collects within the scope of its activities are intended for several purposes:
1) Inform professionals so that they can prepare the sessions they are going to hold;
2) Carry out the necessary accounting and billing operations for the services provided;
3) Disseminate campaigns, promotions and training events;
4) Document the clinical process.
2 – In the exercise of its activity, the mind4us platform stores information that is essential to prepare the therapeutic sessions, making them more effective, as well as for carrying out financial operations and invoicing the services provided. In addition, it also stores other information that is important for publicizing campaigns, promotions and training events.
3 - The mind4us platform will store the data collected for up to 24 months after the last time they were used, unless there is a legal obligation to keep them longer.
4 - The client allows the professional to record audio or video during counseling or therapy sessions, if considered strictly necessary for later transcription of information. The professional is responsible for destroying this content within 24 hours of obtaining it.
5 - Any audio or video recording by the client during the sessions is not authorized.
6 – Data holders may request, at any time, information about personal data about themselves, existing on the mind4us platform.
7 – Anyone who has their personal data stored on the mind4us platform can request the deletion of this data at any time, except those that need to be kept for legal reasons, such as tax information, and provided that there is no legal provision to the contrary.
8 - The use of information and communication technologies (ICT) in psychological intervention may present some challenges and limitations, such as technical problems caused by slow connections, as well as issues related to security, privacy and confidentiality that arise from the use of ICT, including mechanisms for recording and monitoring communications or improper access by third parties to the content of interventions. To guarantee the security of the sessions, it is important that the client checks the security of his own equipment, installing programs that detect threats and avoiding the use of public computers to hold sessions.
9 – In case of breach of data security, the respective data holders as well as their legal representative will be informed of the incident.
10 – The security dangers that may occur during or after the use of communication technologies are the same that apply to all online platforms, including data theft, data hijacking or contamination of devices through the use of outdated software by the customer.
11 – mind4us excludes any liability arising from identified risks or others that cannot be directly and exclusively attributable to it.
12 – Mind4us is a technological mediation platform between clients and professionals. In carrying out its activities, mind4us uses the Wix platform, which complies with the ISO 27001 standard. The ISO 27001 standard is the international standard and reference for information security management.
13 - The servers in use for communications use encrypted data transaction systems, and security standards and guarantees can be consulted at https://www.wix.com.
14 – The price for the services is what appears on the mind4us Platform at the time the customer makes the payment. After payment, the corresponding payment receipt is sent to the email address provided by the latter.
15 – The communication established between the client and the professional can be synchronous or asynchronous. Regardless of this typology, communication takes place via the mind4us platform, using one of the following modes: Video, Audio or Chat.
16 – By agreement between the professional and the client, different communication methods may be used in combination.
By subscribing to this consent, the client declares that he is duly informed about all matters relevant to the provision of the services to be contracted and for the preservation of his rights, freedoms and guarantees.
