Preamble
Carlos Miguel Rodrigues, a private limited company with NIPC 219138265, is the company that owns the mind4us brand, with commercial headquarters at Rua Augusto Fraga n34 1esq
7830-680 Mem Martins.
This document aims to establish the terms of access and use of the mind4us platform, determining the respective conditions of use.
Henceforth, all mentions made of the mind4us platform will be referred to as mind4us.
Henceforth, all mentions made to citizens using the platform will be referred to as Users;
From now on, all references made to citizens providing services through the platform will be referred to as Professionals;
Article 1
access condition
Accessing and browsing mind4us depends on accepting the following principles:
1 - When accessing mind4us for the purposes of exploring content or accessing services, Users expressly declare their full agreement with the terms and conditions set out in this document.
2 - When accessing mind4us for the purpose of exploring content or accessing services, Users expressly declare their informed consent, under the terms of that agreement published on the mind4us platform.
3 - In these terms, the acceptance of the Terms and Conditions of Use of the mind4us Platform and the expression of informed consent correspond to the declaration, by the User, of being informed, declaring to explicitly accept the operating conditions of mind4us.
4 – mind4us reserves the right at any time to change all or part of the Terms and Conditions of Use of the mind4us Platform contained in this website, without any need for prior notice.
Article 2
Access Capacity
1 – All citizens who have equipment with access to the internet network have access to mind4us.
2 – Citizens aged 18 years or over are holders of access to the mind4us registration with a view to contracting the services provided.
3 – Citizens under the age of 18 also have access to the mind4us registration with a view to contracting the services provided, provided that they are explicitly authorized by citizens with parental or legal responsibility.
4 - Express consent to the use of the services mentioned in the previous number by customers under the age of 18 is carried out by sending, by email, a written declaration, dated and signed, according to the model in use, sent to contact@mind4us.com.
5 – In the case of access to counseling or therapy sessions, the Professional may make the session dependent on the presence of the citizen with parental or legal responsibility for the minor.
6 – The non-presence of a citizen with parental responsibility in the session of a minor User, when requested by the Professional, may determine the cancellation of the session without any obligation to return the payment made.
Article 3
Available services
1 - mind4us provides Users with an organized set of services, structured as follows:
1.1. -In the field of Psychology:
a) Individual Consultations;
b) Consultations for Couples;
c) Consultations for the Family
d)Consultations for Team Leaders and CEO'S
2 - The provision of the services mentioned in the previous number presupposes the acceptance of these terms and conditions, as well as the specific conditions that may be determined by the professionals, which will always be subject to prior information to Users.
3 - All the Terms and Conditions of Use of the MindFirst Platform are subject to the laws in force in the Portuguese Republic, as well as to the ethical and deontological standards of professional service providers.
Article 4
data usage
1 – The User, by agreeing to these Terms and Conditions of Use of the mind4us Platform, declares to be receptive to contacts that may be made by mind4us within the scope of the company's activity.
2 – For the purposes of the provisions of the previous number, these contacts include those related to the scheduling or holding of sessions, evaluation of services and professionals, post-clearance follow-up of clients and dissemination of initiatives within the scope of mind4us activity .
3 – Users may, if they wish, request clarification on the use of personal data, via the email address contact@mind4us.com
4 - The data collected within the scope of activity at mind4us is treated in accordance with the provisions of the Privacy and Security Policy that is available for consultation on this website and always in compliance with applicable Community and Portuguese legislation.
Article 5
mind4us rights
mind4us reserves the following rights:
1 - Suspend or terminate, permanently or temporarily, partially or totally, according to your will or need and at any time, the platform in use, without prior notice.
2 - Claim intellectual property over all content contained in mind4us, on multiple platforms, except those resulting from links to external sites and others whose sources and authorship are duly noted.
3 – Included in the rights mentioned in the previous number are those that affect the structure of the site, texts, films, photographs, logos.
Article 6
mind4us duties
For the purpose of developing the activity and relationship with Users, mind4us is responsible for:
1 - Check the academic capacity and professional qualification of the professionals who provide services through the platform.
2 - Ensure compliance with applicable ethical and deontological standards and respect the technical guidelines issued by the entities responsible for regulating the professional activities that operate through mind4us.
3 - Make available the technological resources necessary to carry out the contracted acts, under conditions that allow effective sessions to be carried out for the user.
4 - Develop the necessary actions to guarantee IT security.
5 - Provide all clarifications that are legitimately presented by Users.
6 - Return amounts paid on services that may eventually be cancelled, under the terms of this document.
Article 7
User Rights
In the interaction established with mind4us, the User benefits from the following rights:
1- Access professionals registered with mind4us, with the guarantee of their correct qualification and training for their respective areas of activity.
2- Be reimbursed in case of non-performance of a scheduled session due to technical issues not attributable to the User and attributable to mind4us, under the terms of this document.
3- Claim, at any time, the right to forget and erase the data provided, except in cases where, by law, the preservation of such data is mandatory.
Article 8
User Duties
For the purposes of navigation, registration and access to services provided through the mind4us platform, the User's duties are:
1- Provide true and up-to-date information whenever requested by professionals, through registration and administrative services, as well as other interactions that may operate through mind4us, assuming responsibility if the accuracy and veracity of the data is not verified.
2- Provide true and accurate information for billing purposes for the services provided by mind4us.
3- Save the access data to the platform, keeping the appropriate reserve on these, which are personal and non-transferable.
4- Relate with professionals, verbally or in writing, using appropriate language.
5- Guarantee the technical conditions for access to the services provided by mind4us, namely equipment and internet service, without which mind4us will not be responsible for the inability or deficiency in access.
6 - Make use of the technological capabilities made available by mind4us exclusively for the purposes for which they were made available.
7- Respect the intellectual property rights regarding mind4us content.
Article 9
Scheduling and carrying out consultations
1 – The carrying out of queries is preceded, sequentially, by the following acts on the part of the client:

Registration;

Declaration of agreement and acceptance of the Informed Consent, Terms and Conditions of Use of the mind4us Platform and Terms of the Privacy and Security Policy.

Professional choice;
-
Scheduling;
-
Payment completion.
2 – After making the payment, the Customer is notified by email of confirmation of payment and consultation.
3 – If necessary, the client may request the rescheduling of the session, at least 24 hours in advance.
4 – In case of cancellation, the amount paid may be refunded, provided that this is communicated within a period equal to or greater than 24 hours after the session.
5 – For the purposes of paragraphs 3 and 4 of this article, failure to comply with the 24-hour notice period implies non-refund of the amount paid.
6 – On the day and time scheduled, the link to the video conference system is sent to the User.
7- Sequentially, the User and the Professional access the platform by starting the respective session.
7 – If the User does not attend the session at the indicated time, a tolerance of 15 minutes will be granted, after which the session will be cancelled, with no right to refund the amount paid.
8 – If the User attends the session, even if late, it will take place during the remaining time for the session, considering the initially scheduled time.
9 – If there is any delay on the part of the professional, the client may claim the refund of the amount paid, in which case the session will be cancelled.
Article 10
payments and returns
1 - Payments made by Users for contracted services will be made through the means provided by mind4us;
2 - Payment is made in advance and must be made up to 24 hours before the appointment/session. Only with payment and receipt of the same, the session will be effectively confirmed.
3 – The User may cancel the scheduled session up to 24 hours before the start time.
4 – The cancellation of the session under the terms mentioned in the previous number generates a credit for the service in the same amount, on a date to be determined, depending on the availability of the User and the Customer.
5 – If the scheduled session is not held due to technical issues not attributable to the User, the User has the right to reschedule or fully refund the amount previously paid.
6 – There is no refund of the amount paid by the user in case of non-performance of the scheduled session due to technical issues or others attributable to the User.
Article 12
Processing of Personal Data
1 – mind4us scrupulously complies with the applicable Portuguese and EU legal regimes in terms of data processing and protection.
2 – mind4us develops adequate efforts to preserve computer security and safeguard data against possible cyber-attacks.
Article 13

mind4us may provide data provided by the User, only if the national authority with competence for the purpose determines it.
Article 14
disclaimer
1- mind4us is not responsible for damages or irregularities practiced by third parties intentionally and that may constitute a crime, namely for usurpation of personality or illegal access to data.
2 - mind4us is not responsible for service weaknesses resulting from the use of outdated technology by the User.
3 - mind4us is not responsible for technical deficiencies that are the responsibility of others, namely energy and internet service providers, fundamental for the normal functioning of the services.
4 – Mind4us is not responsible for the contents of third-party sites accessible through links available on this platform, nor does it subscribe to its contents, its use being the sole responsibility of the Users.

Copyright
1 - All content on the mind4us platform is the property of Carlos Miguel Rodrigues, your rights being reserved under the terms of the law.
2 – To Carlos Miguel Rodrigues reserves the right to sue the agents for any violation or abuse that may be committed in terms of the usurpation of intellectual property.
Article 16
Litigation and enabling rules
1- All services provided through mind4us are subject to Portuguese and European Union legislation.
2- In case of divergence or litigation, a procedure will be initiated with the competent Portuguese legal institutions.
Article 17
Final dispositions
1 – The framework of all matters that are not explicitly covered in these Terms and Conditions of Use of the mind4us Platform will be subordinated to the applicable Portuguese and Community legislation, to the regulatory and guiding provisions of the regulatory bodies of the professions that carry out activity on the platform.
2 - The Jurisdiction of the Comarca of Sintra is hereby designated, to resolve any disputes resulting from the relationship established within the scope of mind4us.
